Terms of Service

The contract between you and Mintelier Gallery. Please read carefully before transacting on the platform.

1. Acceptance of terms

By creating an account on Mintelier Gallery, signing in, browsing, bidding, minting, listing, or completing any transaction on the platform you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction. You must not be subject to international sanctions and you must not be using the platform to circumvent any law that applies to you. Each account is personal to a single individual or entity and may not be shared.

3. Internal ETH ledger

The Mintelier wallet is an internal ledger denominated in ETH. Balances reflect amounts available to spend on the platform and do not represent a custodial relationship outside of Mintelier Gallery. Deposits are credited automatically once the on-chain transaction reaches the required number of confirmations on the assigned deposit wallet. Withdrawals are processed in the order received and may be subject to additional identity verification for compliance.

You are responsible for the accuracy of any external wallet address you provide and for safeguarding the credentials of your account.

4. Minting and ownership

By minting an artwork you represent and warrant that you hold every right necessary to publish the underlying media, that the work does not infringe any third-party copyright, trademark, right of publicity, or moral right, and that the metadata you submit is accurate.

Mintelier Gallery may, at its discretion and without notice, remove or hide works that violate these warranties, infringe third-party rights, or breach the prohibited-content policies below.

5. Royalties

Artists may set a royalty between 3% and 20% per piece. Royalties are paid automatically on any secondary sale executed on Mintelier Gallery. Mintelier cannot enforce royalties on transfers that occur outside the platform.

6. Fees

Mintelier Gallery may charge a per-mint fee, a marketplace commission on primary and secondary sales, and a network reimbursement on withdrawals. All applicable fees are disclosed at the moment you confirm the relevant action. Fees may change with reasonable advance notice posted in your dashboard.

7. Prohibited conduct

  • Fraud, market manipulation, wash trading, or self-dealing intended to inflate apparent activity or price.
  • Uploading content that infringes third-party rights or violates applicable law.
  • Harassment, hate speech, sexual content involving minors, or threats directed at any person.
  • Attempts to bypass platform controls, including scraping at abusive rates, exploiting bugs, or attempting unauthorised access.
  • Money laundering, sanctions evasion, or financing of illegal activity.

8. Disclaimers

Mintelier Gallery is provided on an “as is” and “as available” basis. Digital art is a volatile and speculative market. We make no representations about the future market value, liquidity, or aesthetic merit of any artwork, and we do not provide investment advice.

9. Limitation of liability

To the maximum extent permitted by law, Mintelier Gallery, its affiliates, and its service providers shall not be liable for any indirect, consequential, special, incidental, or punitive damages, including without limitation lost profits, lost data, or diminished value of artworks. Our aggregate liability for any direct damages shall not exceed the fees we collected from you in the twelve months preceding the event giving rise to the claim.

10. Suspension and termination

We may suspend, restrict, or terminate accounts that violate these terms, that pose a security risk, or where required by law. You may close your account at any time, subject to settlement of any pending transactions. Termination does not relieve either party of obligations accrued before termination.

11. Changes to these terms

We may revise these Terms of Service from time to time. Material changes will be communicated through the platform or by email. Continued use of the platform after a change constitutes acceptance of the revised terms.
